Q1: Vodafone mobile phone contract, but did not get a cell phone?
#iPhone11 I have at Vodafone 4 weeks ago on 9.11.2019 concluded a contract (iPhone 11 with a tariff) on 18.11.2019 it should come supposedly. I was really happy and then the bitter disappointment came, it would mean that it would not come because of a technical mistake. This time it will be another two weeks to wait until St. Nicholas's Day. As I said done, Nicholas was at the door and you were disappointed again, this time it would mean that the iPhone XS has been ordered. All well and good, the employee told me that the order has been made again, it would take 3 days to arrive, so today. Today we were there suburb, the employee said that nothing was marked and no order in our name. Now we were at another Vodafone shop earlier and said that it is strange that the owner is doing this. He advised us to call the Consumer Center or to call / write by mail. We have done that now and are waiting for their answer.
A: One could terminate the contract because of non-fulfillment of the contractual obligations. but you would have to set the partner a reasonable period to fulfill the contractual obligation (at least 14 days). refer to paragraph 314 BGB. Termination of continuing obligations for important reasons.
